Terms of Service

1. Agreement to Terms

These Terms of Service ('Terms') constitute a legally binding agreement between you (the 'Merchant' or 'User') and Hexis Software regarding your access to and use of the Virtual Try-On SaaS platform. By registering an account, embedding our widget, or utilizing our APIs, you expressly accept these Terms in their entirety.

2. Service Provision and Licensing

We grant you a limited, non-exclusive, non-transferable, and revocable license to integrate our VTO widget into your e-commerce properties. The Service is provided primarily as a conversion-enhancement tool.

• SaaS Availability: While we strive for 99.9% uptime, the Service is subject to occasional maintenance, API rate limits, and underlying infrastructure dependencies.
• Generative AI Disclaimer: The Service employs advanced generative AI to simulate garment fit. Results are approximations intended for illustrative purposes and do not constitute a guarantee of physical fit, color accuracy, or fabric drape.

3. Acceptable Use and Content Restrictions

You agree not to exploit the Service for any unlawful, deceptive, or malicious activities. Specifically, you shall not:

• Submit, or encourage end-users to submit, images containing explicit, defamatory, or non-consensual content.
• Attempt to reverse-engineer, decompile, or extract the source code or underlying AI models of the VTO engine.
• Bypass, circumvent, or exploit the platform's billing mechanisms, API rate limits, or automated domain security verifications.

4. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, Hexis Software and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. You agree to indemnify and hold harmless Hexis Software from any claims resulting from your breach of these Terms or misuse of end-user data.

5. Subscription, Billing, and Termination

Access to premium features requires an active subscription via our authorized payment processor (Stripe). We reserve the right to suspend or terminate service immediately and without prior notice in the event of payment failure or violation of these Terms.
